How Idaho Courts Address Visitation & Parenting Plans
Idaho courts decide custody and visitation matters according to the best interests of the child under Idaho Code § 32-717. The outcome depends on the evidence, the family’s circumstances, and the applicable law. A parenting plan should translate those considerations into terms that parents can understand and follow.
Idaho Code § 32-717B presumes that joint custody is in a minor child’s best interest unless a preponderance of the evidence shows otherwise. A preponderance means the evidence demonstrates that something is more likely true than not. The joint-custody presumption is reversed when a parent is found to be a habitual perpetrator of domestic violence.
Depending on the family’s needs, written parenting-time terms can address:
- Regular weekday and weekend visits
- Holiday and school-break schedules
- Vacation and summer parenting time
- Exchange times and expectations
- Parent-child communication between visits
Third-party visitation requires careful legal analysis. In 2022, the Idaho Supreme Court held that Idaho Code § 32-719, the former grandparent-visitation statute, was unconstitutional because it violated parents’ fundamental rights to make decisions concerning their children’s care, custody, and control. Grandparents and other third parties shouldn’t assume they have a general right to visitation under that former law.

When a parent reports missed visitation or recurring schedule conflicts, we begin by reviewing the existing parenting-time order. We distinguish what the order requires from the circumstances causing the disagreement, including conflicts involving the regular schedule, exchanges, or special dates.
We also handle requests to modify parenting time after a substantial change in circumstances. We examine the order, what has changed since it was entered, and the client’s goals. Whether a modification is appropriate depends on the facts and the best interests of the child.
