An example of this type of violation:  Parent A has been granted primary physical custody of their child, with Parent B having visitation rights every other weekend. Parent B keeps the child for additional days beyond their allotted visitation period without communicating or seeking Parent A’s consent. This causes stress and worry for Parent A and violates the custody arrangement. 

After receiving a filing, the court can enforce the order through various means. Depending on how the request is made, this could include mere enforcement, compensatory time, adjusting the custody arrangement, imposing fines or attorney’s fees, or having the violator sentenced to jail time in the most severe cases. Violation of child custody orders is taken seriously in Idaho, as it interferes with the child's well-being and the parental rights of the aggrieved parent.

Enforcing Idaho Alimony Orders

Alimony orders, or spousal support, provide financial assistance to a lower-earning spouse following a divorce.  

Suppose ex-spouse E is court-ordered to provide financial support to ex-spouse F in the form of alimony and either reduces the amount or stops making these payments entirely without a court order. In that case, they are in violation. 

In these circumstances, the alimony recipient can file a motion for enforcement or to hold the other party in contempt of court. The court can then enforce the order by wage garnishment, seizure of property, or other means. Persistent failure to comply with alimony obligations can also lead to a contempt conviction, fines, and possible incarceration.

Typically, in both child support and alimony enforcement cases, we obtain a judgment from the Court along with a writ of attachment or execution. We’ll then have the sheriff serve it to their employer, who is required by law to withhold the wages and send them to the sheriff/constable to distribute to the attorney for the creditor.
 

Other Court Orders

A protective order, also known as a restraining order, is a court-issued mandate designed to protect a person from abuse, harassment, stalking, or threats from a family or household member. Violating a protective order is a serious offense in Idaho that can have significant legal consequences. 

Examples of such violations include contacting the protected person when ordered not to, coming within a certain distance of the protected person or their home, school, or workplace, or causing or threatening physical harm to the protected person.

If a protective order is violated, the protected person can take immediate action to enforce it. The violation should be reported to law enforcement, who can arrest and charge the violator. 

The reporting person can also file a contempt motion in court, alleging that the violator has willfully disobeyed the court's order. Penalties for violating a protective order can include fines, jail time, and mandatory participation in counseling programs.
