Idaho’s Community Property Principle

Idaho courts follow the “community property” principle in deciding marital property division and alimony. This means that the court presumes that all assets and debts acquired during the marriage are considered community property and are divided equally between the spouses. 

However, the court can deviate from this principle in certain circumstances. This is where a skilled and experienced family law attorney can be a great asset to you in a divorce.

Alimony/Spousal Support in Idaho

In determining alimony, the court considers several factors, such as the duration of the marriage, the age and health of the parties, their standard of living during the marriage, their financial or employment prospects, and their economic resources and needs.

In determining child-related issues such as custody, visitation, and support, whether during the divorce process or afterward, the court's primary basis is the child’s best interest. Factors such as the parent’s wishes, the child's wishes (if they are of a suitable age), the relationship of the child with each parent, the child’s adjustment to his or her home, school, and community, each parent’s character and circumstances, the need to promote continuity and stability in the child’s life, and whether there has been domestic violence in the home are considered in custody disputes. 

Child Support

Idaho child support is a crucial component of family law, designed to ensure the financial well-being and stability of children following the separation or divorce of their parents. It fundamentally operates on the premise that both parents share the financial responsibility of raising their children. Importantly, child support is considered the child's right rather than the custodial parent's. 

The determination of child support follows specific state guidelines. These guidelines consider several factors, including each parent’s income, the number of children, and the time each parent spends with the children. The aim is to provide a fair and equitable distribution of the financial burden, ensuring the child's needs are met without undue hardship to either parent.

While these guidelines are generally followed, the court may deviate under certain circumstances. For instance, if adhering strictly to the guidelines would lead to an unjust outcome or the child’s needs are exceptional (such as special medical or educational needs), the court may consider a deviation. 

However, any deviation from the standard guidelines must be justified in writing by the court, emphasizing the child’s best interests above all.
